Terms of service
This project …………. has a completion date based on …….. working weeks (based on a 5-day working week 7am till 3pm). Delays such as weather, pandemic closures, issues with relevant authorities or client financial difficulty will not be held liable to Substructure Solutions. Substructure Solutions holds no responsibility for delays whereby any landlord or third party intervenes to delay the project.
The ‘client’ is …………... The ‘contractor’ is Substructure Solutions PTY LTD.
Works will be completed providing, that there are no delays by the client or the clients’, suppliers and contractors who are completing works on the proposed site. Substructure Solutions will attend to the site as scheduled by the client’s access permissions.
Delay in payment or delay due to changes of the scope of works and/or the delay of submitting relevant documentation as required by law will result in non- attendance by the contractor.
Works carried out as per specifications provided by the client and listed on the Home Building Contract attached to this document.
Payment is to be paid by client within (7) day of receipt of dated invoice. Failure to provide payment as agreed will result in non-attendance by Substructure Solutions tradesman and employees. Thus, creating a delay to the project.
Expense claims: Any expenses incurred that have not been listed on above (yet required to complete any services required) will be charged back to the client with supported evidence including receipts and documented reason. All expenses are required to be paid weekly.
Substructure Solutions will complete all works in a safe, professional and diligent manner with clear communication with the client at all stages. Substructure Solutions will not deliberately delay the project and apply all services as required to complete works in the designated time frame.
Should access to the listed site address be denied to Substructure Solutions employees or contractors, the Client will be responsible for regaining access and for tradesman charges for a minimum of 4 (four) hours per tradesman (as per Schedule of Rates) with each invoice referring to this clause.
The contents of this document are confidential. No part of this document may be reproduced or transmitted in any form without the expressed permission of Substructure Solutions or unless required by NSW state Laws.
Substructure Solutions Joinery, building works or drawings may not be reproduced without the expressed permission of Substructure Solutions.
This quotation has been produced to the best of Substructure Solutions understanding of the drawings and specifications provided by ‘the client’. Substructure Solutions accepts no responsibility for any errors or omissions by architect plans or associated advisors provided by the client.
Substructure Solutions will ensure that all building specifications will meet BCA requirements especially Section J incorporating energy efficiency. Breach of the BCA is to be notified to the client and addressed appropriately.
Where unforeseeable variations occur either by the clients request or site-specific incidents; such extra works will be considered variations. Therefore, the price of the above-mentioned works is not final and maybe subject to variation. Such variation will not proceed without instruction from the client(s) and whereby the client has been prior informed of the variation costs, reasons and effect on the schedule.
Variations are payable as follows. 30% deposit upon acceptance by the client and full payment upon completion. Variation margin is calculated at 15% or in a lump sum form.
Practical Completion: The works are ‘Practically Completed’ when the Project is reasonably fit for use or occupation as determined by the clients Private Certifier or when an Occupational Certificate has been issued, whichever occurs first. (Minor defects are excluded from the practical completion and are not to be factored for this part.)
All goods supplied remain the Property of Substructure Solutions until they are paid for in full. We also reserve the legal right to retrieve all our products, under The Building Services Security of Payments ACT 1999, if final payment is not received upon completion, no certificates will be issued to the client.
By engaging Substructure Solutions for services, the client acknowledges and agrees that the Company may take photographs and/or videos of the work performed, including progress and completed projects.
Defects will be addressed upon receipt of full payment to Substructure Solutions.
